We may ask you to provide personal information that will enable us to enhance your use of our Services, including, but not limited to, purposes such as, to facilitate correspondence with you, to facilitate or complete transactions, or to provide an accurate price for one or more services we are providing such as internet, phone, cable, streaming, and home security services. You always have the choice whether to provide personal information. If you choose to provide your personal information and agree to our Terms and Conditions, you will be consenting to the Navigo’s collection and use of your information even if it is protected by a security freeze. YOU AGREE NOT TO HOLD NAVIGO (OR, ITS STOCKHOLDERS, AFFILIATES, PARENT COMPANY, LICENSORS, PARTNERS, MEMBERS, DIRECTORS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, SUCCESSORS, ASSIGNS AND CONTENT PROVIDERS (COLLECTIVELY, “MEMBERS”)) LIABLE FOR ANY DAMAGES, EXPENSES, LOSSES, SUITS, CLAIMS, AND/OR CONTROVERSIES
THAT HAVE ARISEN OR MAY ARISE, WHETHER KNOWN OR UNKNOWN, RELATING TO YOUR USE OF OR INABILITY TO USE THE NAVIGO SERVICES, INCLUDING WITHOUT LIMITATION ANY LIABILITIES ARISING IN CONNECTION WITH THE CONDUCT, ACT, DELAY OF PERFORMANCE OR OMISSION OF ANY USER OR THIRD PARTY PROVIDER (OR ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND ANY THIRD PARTY PROVIDER), ANY DISPUTE WITH ANY USER OR THIRD PARTY PROVIDER, ANY INSTRUCTION, ADVICE, ACT, OR SERVICE PROVIDED BY NAVIGO OR ITS MEMBERS, AND ANY DESTRUCTION OF YOUR INFORMATION.
UNDER NO CIRCUMSTANCES WILL NAVIGO OR ITS MEMBERS OR THIRD PARTY PROVIDERS BE LIABLE (1) FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN AN ACTION FOR CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST EARNINGS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, (2) FOR ANY VIRUSES, BUGS, TROJAN HORSES, SYSTEM UPGRADES OR MALFUNCTIONS, INTERNET DELAYS OR MALFUNCTIONS, OR THE LIKE (REGARDLESS OF THE SOURCE OF ORIGINATION). NAVIGO AND MEMBERS DO NOT ACCEPT ANY LIABILITY WITH RESPECT TO THE QUALITY OR FITNESS OF ANY WORK PERFORMED IN CONNECTION WITH THE NAVIGO SERVICES. THE NAVIGO SERVICES CONNECTS USERS WITH THIRD PARTY PROVIDERS. WE ARE NOT RESPONSIBLE FOR ASSESSING THE SUITABILITY, LEGALITY OR ABILITY OF ANY THIRD–PARTY PROVIDER AND YOU EXPRESSLY WAIVE AND RELEASE NAVIGO FROM ANY AND ALL LIABILITY, CLAIMS OR DAMAGES (ACTUAL, DIRECT OR CONSEQUENTIAL) OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, SUSPECTED AND UNSUSPECTED, DISCLOSED AND UNDISCLOSED, ARISING FROM OR IN ANY WAY RELATED TO ANY THIRD–PARTY PROVIDER. WE EXPRESSLY DISCLAIM ANY LIABILITY THAT MAY ARISE BETWEEN YOU AND ANY THIRD–PARTY PROVIDER. THE QUALITY OF THE SERVICES PROVIDED BY THIRD PARTY PROVIDER IS ENTIRELY THE RESPONSIBILITY OF THE THIRD–PARTY PROVIDER. YOU UNDERSTAND, THEREFORE, THAT BY USING THE NAVIGO SERVICES, YOU USE THE NAVIGO SERVICES, AND THIRD–PARTY PROVIDER, AT YOUR OWN RISK. NOTHING IN THIS AGREEMENT OR THE NAVIGO SERVICES CONSTITUTES, OR IS MEANT TO CONSTITUTE, ADVICE OF ANY KIND. IF YOU REQUIRE ADVICE IN RELATION TO ANY LEGAL, FINANCIAL OR MEDICAL MATTER YOU SHOULD CONSULT AN APPROPRIATE PROFESSIONAL.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN TYPES OF DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. BY USING THE NAVIGO SERVICES, YOU AGREE THAT THE EXCLUSIONS AND LIMITATIONS OF LIABILITY SET OUT IN THIS AGREEMENT ARE REASONABLE. IF YOU DO NOT BELIEVE THEY ARE
REASONABLE, YOU MUST NOT USE THE NAVIGO SERVICES.
California Waiver. If you are a California resident, to the extent permitted by California law, you waive California Civil Code Section 1542, which states: “A general release does not extend to claims which the creditor or releasing party does not know or suspect to exist in his favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party,” or any statute or common law principle of similar effect.
User Submissions. Any information or material you transmit to or through our website, including any data, questions, comments, suggestions or any other communications is and will be treated as non-confidential and non-proprietary, unless it contains personally identifiable information covered by our Privacy Policy. Please do not send us any confidential or proprietary information through or to our website, as we reserve the right to use any ideas, concepts, know-how, techniques, or other information, other than personally identifiable data, contained in any communication you send to us via our website for any purpose whatsoever, including, but not limited to, developing and marketing products based on such information.
Although Navigo may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards and similar communications on our website, we are under no obligation to do so, and we assume no responsibility or liability arising from the content of any such locations or communications, including any errors, defamation, libel, slander, omissions, falsehoods, obscenities, pornography, profanities, danger or inaccuracies contained in any information within such locations or communications. If you are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability or otherwise violate any law. Navigo will fully co-operate with any law enforcement authorities or court order requiring or directing Navigo to disclose the identity of anyone posting any such information or materials on the website. Without limiting any of the foregoing, you are prohibited from engaging in any interstate communications in violation of 18 USC Section 875, or any other federal, state or local law applicable to communications or the use of electronic devices.
Posting any material which is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person’s privacy, or otherwise violative of any law is prohibited. Doing so may lead to you being banned from participating. Note that all IP address are logged and may aid in enforcing these conditions.
Navigo has the right to remove, edit, move or close any discussion at any time should they see fit. If a post contains spam, i.e., unsolicited advertising, it will be removed and the poster may be banned.
Please remember that we are not responsible for any messages posted. We do not vouch for or warrant the accuracy, completeness, or usefulness of any message, and are not responsible for the contents of any message. The messages express the views of the author of the message, not necessarily the views of Navigo. Any user who feels that a posted message is

General. Navigo may revise these Terms and Conditions of Use from time to time, without prior notice, by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then-current Terms and Conditions of Use to which you are bound.
The Terms and Conditions of Use are governed by and should be construed in accordance with the laws of the State of Georgia, USA, without regard to any conflicts of laws provisions. You agree that any disputes in connection with your use of the Navigo website or any Navigo web page, or this Terms and Conditions of Use, and any enforcement thereof, shall be resolved in a federal or state court located in Fulton County, Georgia.
If any provision of the Terms and Conditions of Use is deemed to be invalid or unenforceable by a court of competent jurisdiction, the section or sections determined to be invalid shall be considered stricken from the Terms and Conditions of Use and the remainder of these Terms and Conditions shall remain in full force and effect.
NAVIGO REFERRAL PROGRAM TERMS AND CONDITIONS
These Terms and Conditions of Use apply to the Navigo Referral Program. By referring a customer (“Referring Customer”), the Referring Customer agrees to these terms.
Rewards. Under the Program, eligible Referring Customers satisfying all Program eligibility criteria shall each receive a reward (“Reward”). The type and amount of the Reward shall be determined by Navigo and is subject to change at Navigo‘s sole discretion. Effective January 1, 2022, the Reward under the Program is a $100 Visa Gift Card to Referring Customers that refer ten (10) customers that activate services through Navigo (“Referred Customer”).
Eligibility. Rewards for Referring Customers only are available to Navigo customers located in serviceable areas with accounts in good standing, for the activation of new
services of a Referred Customer and any required right of rescission period has expired. Services are subject to change by Navigo.
Reward Requirements: For the Referring Customer to receive a Reward, the Referring Customer must refer another qualified individual for the Service and the Referred Customer must:
Sign up for services through Navigo;
Not have been a Navigo Customer within 120–days of the date of referral;
Activate Service with Navigo’s third-party service providers; and
Any applicable Right of Rescission period has expired.
Limits & Expiration. The total value of rewards per customer are limited to one Reward per customer. Various Rewards may be offered from time–to–time at the sole discretion of the Navigo.
Referral Message Limits. Referring Customers are welcomed to send unlimited social media and email messages, but they shall be limited in the number of texts messages sent to 50. Any Referring Customers found to be sending mass texts or texts to individuals with whom he/she has no personal relationship will be disqualified from the Program and will not receive any Rewards.
Privacy and Information: By participating in the Program, the Referring Customer and Referred Customer agree that Navigo may provide their information (such as first and last name and installation date) to the Referring Customer, Referred Customer, and others, including third party providers for purposes of administration of the Program.
General Provisions: If multiple referrals for the same person are received only one Reward, subject to these terms, will be provided for the referral first received by Navigo, as determined by Navigo.
Rewards may not be combined with other offers or promotions.
This offer is intended for Navigo customers to refer their friends and family to Navigo as new customers and should not be generally advertised or marketed in any commercial manner. Commercial accounts/customers not eligible for the Program.
Program participation is limited to Navigo residential customers with accounts in good standing. Property owners, sales agents, managers, leasing/rental agents, and landlords, or their respective agents, employees or contractors, of apartments, townhouses, condominiums or other types of multiple dwelling units are not eligible to participate in the Program or receive any Rewards, discounts or other promotional offers under the Program or for referring a customer who rents, purchases or otherwise obtains a unit owned, managed, leased and/or maintained by such person.
Navigo reserves the right to change Rewards and eligibility criteria under the Program, and to alter, modify, suspend, or terminate the Program at any time upon notice, which notice may be provided through the Site, mail, e-mail or such other methods as determined by
Navigo in its sole discretion. Terms subject to change.
